<P><strong>La dmocratie constitutionnelle</strong> affronte des dfis nouveaux ou renouvels (rle de la socit civile , mondialisation, question religieuse). Ltat lui-mme est mis en cause et la question de son dpassement est pose, quand, par ailleurs, la vie politique des peuples parat osciller entre la futilit (la peopolisation ) et la fatalit (guerres, pauvret, catastrophe cologique). Le droit constitutionnel est en cause.</P>
<P><strong>Le Droit exprime leffort multimillnaire</strong> de matrise raisonne de la vie sociale, et le droit constitutionnel son application au corps social, lui-mme organis dans un cadre territorial dtermin (ltat), dot dun pouvoir qui en mane (la dmocratie) et garantissant lautonomie des membres du groupe (les droits et liberts).</p>
<P><strong>La premire partie de cet ouvrage</strong> dcrit la formation historique et intellectuelle de ltat, son universalisation et les conflits des diverses formes de la dmocratie. La deuxime partie dcrit le champ du droit constitutionnel: dmotique (une terre, un peuple), politique (un pouvoir), civique (les liberts). La troisime partie pose la question, rarement aborde, des limites du droit constitutionnel, en particulier dans le contexte de la construction europenne.</p>
<P><strong>Lapproche synthtique</strong>, sa dimension historique et comparatiste, son systme de numrotation analytique feront de ce prcis un instrument de travail prcieux pour les tudiants et pour la prparation des concours administratifs.</p>

The State itself has been blamed and the question of its being obsolete has been posed, when, moreover, the political life of the people seems to teeter between futility (“peopolisation”) and fatality (war, poverty, ecological catastrophe). The constitutional right is the cause.</p>
<P>Law expresses the multimillenial effort for reasoned control of social life, constitutional law its application to the social body, itself organized in a determined territorial context (the State), endowed with power derived from this body (democracy), and guaranteeing autonomy of the body's members (rights and liberties).</p>
<P>The first part of this work describes the historical and intellectual formation of the State, its universalization and the conflicts between different forms of democracy. The second part describes the field of constitutional law: demotic (one earth, one people), political (one power), and civic (liberties). The third part poses the rarely addressed question of the limits of constitutional law, particularly in the context of the European construction.</p>
