Restorative justice is becoming part of our penal institutions, both in Europe and the United States. The authors of this collective issue see this as a desirable trend and claim that more work needs to be done in identifying the political, legal and moral reasons for punishing in a restorative way. We argue that these reasons are at least twofold. First, restorative justice is well placed when it comes to promoting important normative goods, such as freedom or democracy. Second, restorative programs are practically efficient and psychologically in tune with our well considered moral judgments in penal matters. This collective issue is aimed at academics, criminal justice practitioners, and at all the lay citizens who are interested in questions of punishment.
La justice restaurative est en train de devenir une partie constitutive de nos institutions pénales, à la fois en Europe et aux États-Unis. Les auteurs de ce numéro collectif considèrent que cette tendance est souhaitable et que, de ce fait, les raisons politiques, juridiques et morales pour punir de manière restaurative méritent d'être examinées de plus près. Ces raisons sont au moins doubles. Premièrement, la justice restaurative est bien placée pour promouvoir des biens normatifs comme la liberté et la démocratie. Deuxièmement, les programmes restauratifs sont pratiquement efficients et psychologiquement compatibles avec nos jugements bien considérés en matière pénale. Ce numéro collectif s'adresse aux universitaires, aux praticiens de la justice pénale et à tous les citoyens qui s'intéressent à la question des peines.
